Provided
both you and your spouse mutually want a divorce, have no dispute as to division
of your property, and at least one of you has been a resident of Pennsylvania
for at least six (6) months, then you may proceed forward and obtain a no-fault
divorce in Pennsylvania.
WHAT WE DO: We
prepare, mail and file all the required documents. We include self
addressed stamped envelopes in all correspondence to both parties. We
prepare and send your spouse all required court documents. We direct your
spouse which documents to sign, where to sign on those documents, and when to
return those documents to the office. We advise you by mail whenever we
have sent your spouse correspondence, and we copy you the pertinent documents we
sent. We advise you if your spouse has failed to return those
documents. We are available at all times to answer your questions
concerning your case by either telephone or email.
WHAT YOU DO: If
you decide a no fault divorce is for you (after you've read the information
below), then complete the application, either
online or by sending it to us via mail. Or, if you're not sure whether to
proceed or not, and you have questions, please call me (Atty Kurlancheek) at
your convenience at 800-324-9748 or email me at bkurlancheek@gmail.com. If I'm not in the office, or with clients, you'll get the answering
machine. I try to return all calls within 24 hours. Once you've
submitted the application, you're pretty much done. We'll take care of the
rest. No court appearances, no hearing, no additional fees. The one
time charge of $295 covers all court filing fees, postage and attorney
fees. For more specifics, of the two different kinds of no fault divorces,
and about how long each one takes, please read on.....
THERE'S TWO KINDS
OF NO-FAULT DIVORCES . . . .
1) FIRST KIND: If you've been
separated for less than two years: A no-fault uncontested divorce takes
about 5 to 6 months from the time I receive the application. Your spouse's notarized signature/consent is required
towards the end of the divorce period on a form I provide him/her, as well as
your knowledge of your spouse's exact mailing address (or email) throughout the
divorce period. This 5 to 6 month time period encompasses Pennsylvania's
mandatory 3 month waiting period, which occurs between the time your spouse
first receives service
of the Divorce Complaint (by 1st class mail) - about 6 weeks into the process, and the time at which thereafter I
will provide him/her the final consent form - about 4 months into the process (also by 1st class mail.)
In other words, I will
contact your spouse twice, and each time I will need their signature. The first
time is about 6 weeks into the process, and the second time is about four months
into the process. Each time I write them they will be prompted by me to return something,
and each time I will provide them a pre-stamped and pre-addressed envelope for
them to return to me the designated form.
I attempt to make the whole process as easy as possible for your spouse to
cooperate, with minimal hassle on their part. I provide them a full explanation each time
of what is happening at that stage of the legal process, so that you (and they)
may obtain your no-fault divorce without complication.
2) SECOND KIND: If you've been
separated for more than two years, you will obtain a divorce in a shorter
time, by law, in about 3 months. Spousal consent by signature,
under the procedures I use in my office, is still required.
The fee for either
kind of divorce is $295.00, all inclusive. There are no hidden
costs or fees. Please understand however that successful completion of
your divorce is strictly contingent on:
1. Your
spouse's written signature/consent under either Method; and
2. Your
spouse NOT sending back a written objection under either Method #1 or #2; and,
3. Your
inclusion on the application form
of your spouse's correct and
exact mailing address (or email address if you do not know their address).
4. Either
you, or your spouse, must have been a resident of Pennsylvania for the last 6
months preceding the filing of your divorce action. In other words, e.g.,
if you are a resident of California, and your spouse has been a resident of
Pennsylvania for at least the past 6 months, you may still file for divorce in
Pennsylvania, and you may also be the plaintiff, even though you don't reside in
Penna.
MILITARY APPLICANTS (Stateside and Overseas): You are still considered a resident of Pennsylvania as long
as your state of record, or legal domicile, is Pennsylvania. And if you are stationed overseas,
if you have an APO address, then correspondence re your divorce papers is generally reliable. Or, in the
alternative, I will forward papers to you via email.
OUT-OF-COUNTRY
SPOUSES: I can still obtain your divorce for you, even if your spouse
resides in another country, as long as he or she has a reliable mailing address.
MARRIED IN
A FOREIGN COUNTRY: I can still obtain your divorce for you, valid in all
50 states.
OK. YOU'RE SURE YOU WANT TO BE DIVORCED; YOU KNOW WHERE YOUR SPOUSE
LIVES (ADDRESS), AND YOU'RE SURE HE/SHE ALSO WANTS TO BE DIVORCED. HERE'S
HOW TO PROCEED:
Fill in the Application. Once
the application form and your check or money order are
received, your divorce papers will be mailed to you, for your review,
signature, and return, within 5 to 10 days. Then, once I receive your
signed divorce papers back from you, your divorce will be filed usually the same
day, and your spouse will receive notice and service of the divorce by 1st class
mail about 6 weeks after that.
When I "serve" the initial divorce papers by 1st class mail upon your
spouse, you will receive a copy of the cover letter (which I've sent him/her) at
the same time, so that you know this task has been accomplished.
